United States Regional Privacy Notice.

This United States Regional Privacy Notice is for individuals residing in California, Colorado, Connecticut, Virginia, and Utah, and supplements the information contained in MNTN’s Privacy Policy, which is located at https://mountain.com/privacy-policy/ . It explains how we collect, use, and disclose your personal information and how to exercise your rights under various applicable privacy laws in the United States, including the California Consumer Privacy Act of 2018 (“CCPA”), the Colorado Privacy Act, the Connecticut Act Concerning Personal Data Privacy and Online Monitoring, the Utah Consumer Privacy Act, and the Virginia Consumer Data Protection Act (collectively, the “US Privacy Laws”).

Collection, Use, and Disclosure of Personal Information

We collect information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you (“personal information“). Personal information does not include publicly available information from government records or that we reasonably believe you have made available to the general public, deidentified information (which we do not attempt to reidentify), aggregated information or other exempted information under US Privacy Laws.

The table below sets out the categories of personal information that we have collected and disclosed, and the categories of third parties with whom we disclosed that information for a business purpose, within the last twelve (12) months. We do not collect, use, or disclose information that the US Privacy Laws consider to be “sensitive personal information.” We have not “sold” your personal information nor have we “shared” your personal information, as that term is defined in the CCPA, in the preceding twelve (12) months. Our Website and Services obtain the categories of personal information listed above from the following sources:

  • Directly from you. For example, if you contact us, request our Services, or otherwise provide it to us, and in each instance only to the extent you provide us with your personal information.
  • Indirectly from you. For example, from observing your interactions on our Website.
  • From our customers. For example, through information we collect in the course of providing Services to our customers.
  • From Mobile Measurement Partners. For example, from your interaction with an advertisement.
  • From advertising partners. For example, publishers, ad exchanges, ad networks and other ad technology companies may provide us with information.
  • From our affiliates.

Use of Personal Information

We use and disclose personal information to:

  • Provide, build and improve the Services, including to provide customer users with access to the Services and provide support.
  • Build segment profiles for our customer’s marketing and advertising purposes, where the segment profiles are built exclusively for the specific customer who provided your IP address, cookie ID, and/or hashed email address to allow MNTN to show interest based ads to you on behalf of the customer, and are not used to provide services to other customers.
  • Serve interest-based advertising on an individual’s desktop, mobile, and/or Connected Television device.
  • Engage in analytics and research.
  • Comply with law, prevent fraud, enforce our agreements, exercise or defend legal claims and to protect our rights or the rights of third parties.
  • Provide reporting, attribution and frequency capping for our customers’ advertising campaigns.
  • Communicate with our customers, including providing information about current or future marketing opportunities, updates about our company or our Services, release updates, webinars, and events we are hosting.
  • In connection with a corporate sale, merger, acquisition, or other business transaction or transfer of all or part of our assets.
  • As described to you when collecting your personal information or as otherwise permitted by the US Privacy Laws.

Retention of Personal Information

We keep personal information for a rolling period of two (2) years from the last website visit of our customers’ websites or the Website, as applicable. If our contract terminates with a customer, we do not further collect or use personal information received from the customer.

Your Rights and Choices

Depending on where you live and subject to certain exceptions, some or all of the following rights regarding your personal information may be available to you:

Right to Know

You have the right to request that we disclose certain information to you about our collection, use, disclosure of your personal information and our data practices. For California residents, once we receive and confirm your verifiable consumer request (see Exercising Your Rights), we will disclose to you:

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting that personal information.
  • The categories of third parties with whom we disclose that personal information.
  • The specific pieces of personal information we collected about you.
  • The categories of personal information that we disclosed for a business purposes.

Right to Correct

You have the right to request that we correct inaccurate personal information that we maintain about you.

Right to Delete

You have the right to request that we delete personal information that we collected from you or about you, subject to certain exceptions.

Right to Object to Targeted Advertising

You may have the right to opt-out of the processing of your personal information for the purposes of targeted advertising.

Exercising Your Rights

To exercise any of your rights described above, please submit a verifiable consumer request by emailing us at the following email address: privacyrights@mountain.com or by otherwise using the contact information below.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. To verify your identity, we may need to collect additional information to verify your identity, such as your IP address or government issued ID. Making a verifiable consumer request does not require you to create an account with us.

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. We may ask such third party to verify your identity before processing your request to protect your information and the integrity of our services, such as by providing signed permission from you to make the request on your behalf, and may need to verify their identity, such as by requesting valid government issued ID. You may only make a verifiable consumer request to know twice within a 12-month period.

We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request. In addition, where applicable, we will provide you with more information about our appeal process. When you submit a request or launch an appeal, we will limit our collection of your personal information to only what is necessary to securely fulfil your request or process your appeal. We will not require you or your authorized agent to pay a fee for the verification of your request or appeal. We will not discriminate against you for exercising any of your rights.

Changes to Our Privacy Notice

We reserve the right to amend this Notice. When we make changes to this Notice, we will post the updated Notice on the Website, update the Notice’s effective date and take any other steps as required by applicable law.
